  1. Application of these Terms & Conditions

These terms and conditions (hereinafter referred to as “T&C”) govern the contractual relationship between World Visualization Foundation (“we”, “us”, “our”, World Visualization Foundation in Poland) and event participants (“the Participant”, “you”, “your”).

The subject matter of these T&C is the purchase of tickets for the event specified in the event registration form (the “Event”) and the participation at the Event by the Participant. By submitting your registration, you expressly agree to these T&C.

2. Website Terms of Use and Privacy Policy

The Terms of Use, which describe the terms and conditions for the usage of the Website, are a substantial part of these T&C. If any provision of the Terms of Use is in contradiction with these T&C, then the respective provision of these T&C shall apply. The Privacy Policy of World Visualization Foundation is a substantial part of these T&C. Both documents are published and available on the Website.

3. Registration to Events / Purchasing of Tickets

Tickets for the Event are exclusively sold directly by World Visualization Foundation through our website www.worldvizfest.com or www.worldvisualizationfestival.com or through our ticket purchasing provider (stated on the website). We are not liable for any tickets purchased from third parties.

The purchase price is due at the time when the tickets are purchased. Once a successful purchase transaction has been completed, tickets are delivered in electronic soft-copy via email to the email address nominated by the purchaser. For some ticket types, it may be necessary to complete required information – such as the attendee name or tax identification number – before the tickets can be issued. The ticket acts as a receipt for the transaction and can be used to redeem entry at the event listed on the ticket. A printed hard-copy ticket or an electronic soft-copy ticket detailing the reference number can be used to register for the event.

You are solely responsible for safeguarding your tickets. We don’t assume any liability for lost or stolen tickets. Your ticket grants you access to the Events and services as specified for the ticket category you have purchased.

4. Code of Conduct

By purchasing a ticket to the Event, you expressly agree to comply with the Code of Conduct outlined on the respective Event website. Violations of the Code of Conduct may result in expulsion from the Event without any further liability by us and without any obligation to refund any amounts to you.

5. Refund Policy

We do not offer refunds for purchased tickets. Once purchased, tickets and any inherited registration fees are non-refundable.

6. Check-in / Access to the Event

In-person events: In order to enter the event venue and participate in the Event, you will need to perform a check-in at the respective check-in stations at the venue. You will need to present your ticket by providing a hard copy or by using a digital version of your ticket.

Virtual events: To access a virtual event, you will need to log in to the event platform using your personal access code. This access code will be provided to you shortly before the virtual event starts.

In the case of concession rate tickets (e.g. student tickets, startup tickets, or similar), we may ask you for proof of eligibility before you enter the Event. If you cannot provide such proof, we reserve the right to refuse entrance to the Event without any further liability and without the obligation to refund any amounts to you.

We may ask you to present your ticket and proof of identity at any time during the Event. If you fail to do so, we reserve the right to restrict your access to the Event without any further liability to you and without the obligation to refund any amounts to you.

7. Transfer Tickets / Name Changes

If you can no longer attend the Event, you may send a transfer request to partner@worldvizfest.com until 7 days before the commencement of the Event. Usually, transfers of tickets are free of charge, but we reserve the right to ask for a transfer fee in specific cases. Name changes will be facilitated free of charge and can be requested via email to partner@worldvizfest.com. No name changes will be facilitated 7 days prior to the commencement of the Event.

8. Complaints

Complaints can be made to partner@worldvizfest.com. We will endeavor to resolve any complaints where reasonable.

9. Photo and Video Policy

By participating in the Event, you acknowledge and agree that you may be photographed or video recorded by us or our affiliates. You expressly agree and give World Visualization Foundation and its affiliates the perpetual right and permission to take pictures, video recordings, photographic portraits, or similar at the Event and to use such material for promotional and archival purposes through any media (online, print, television, radio, or similar) and without any liability or compensation. The commercial use of photos or videos taken at the Event by the Participant is strictly prohibited and only possible with our prior written approval.

10. Warranty and Limitation of Liability

World Visualization Foundation does not assume any warranty that the Participant’s expectations of the purchased services are met.

The Participant shall have no claims for damages against World Visualization Foundation of whatever type, irrespective of the legal basis, unless these claims are based on culpable loss of life, bodily injury, impairment of health, intent, gross negligence, or culpable violation of a cardinal obligation by us or by any of our legal representatives, employees, or vicarious agents.

In the case of claims for damages in connection with violation of cardinal obligations that are not based on intent or gross negligence on our part or on the part of any of our legal representatives, employees, or vicarious agents, our liability is limited to the foreseeable amount of damage or loss that is typical of the contract.

To the extent that our liability is limited or excluded, these rules shall also apply to the personal liability of our legal representatives, our employees, and vicarious agents. The liability for slight negligence of World Visualization Foundation, except for personal injuries, shall be excluded.

World Visualization Foundation is not liable for not complying with contractual duties or provisions, if the reason for non-compliance is due to circumstances beyond the control of World Visualization Foundation. This applies particularly to the cases of force majeure.

World Visualization Foundation shall not be liable for any direct, indirect, and consequential damages, in particular, but without limitation to, lost profits and third-party claims arising out of or in connection with the Event or our services. The Participant acknowledges that according to the state of technology there is no process to guarantee error-free execution of an Event or other services.

No liability shall be assumed for correctness and completeness of any information on the website of the Event. World Visualization Foundation takes no responsibility and assumes no liability for any information/content that is posted, stored, uploaded, shared, or transmitted via the website or at the Event, or for any loss or damages that may occur because of such information/content, including, but not limited to defamation, slander, libel, falsehoods, obscenity, or profanity.

World Visualization Foundation shall not be liable for any kind of abuse of data or information by either the Participant or third parties. Further, World Visualization Foundation shall not assume any liability for system failures, disturbances, data loss, and viruses resulting from external attacks or any other reason.

The Participant is obliged to indemnify and hold World Visualization Foundation harmless against any third-party claims resulting from the use of our services or the Participant’s participation at the Event. Any and all claims asserted against World Visualization Foundation by the Participant shall lapse three months after such claims arise, irrespective of the time at which the Participant becomes aware thereof.

11. Visa

World Visualization Foundation will not be liable for the granting of any visas that are required to attend the Event. In the event that an attendee’s visa is not granted, tickets will not be refunded.

12. Changes to the Event / Postponement / Cancellation / Force Majeure

World Visualization Foundation reserves the right, at its sole discretion and without liability, to change the Event format, agenda, content, speakers, topics, venue location, timings, technical and administrative details, and any other aspect of the Event at any time and for any reason. This includes the right to change the Event from a physical event to a virtual event and vice-versa.

The Participant acknowledges that such changes may be required for the benefit and safety of the Event and the Event participants as a whole (e.g., to ensure public health or safety or if the organization of the Event would be impracticable, illegal, or impossible).

In case the Event is being canceled, relocated, or postponed to another date for reasons other than a Force Majeure event, we may offer you the option of participating at the rearranged or rescheduled or any other Event we choose to organize. If you promptly, and within 14 days after being informed by World Visualization Foundation about the rearranged or rescheduled event, notify us in writing that you do not wish to participate in the rearranged or rescheduled event, then you will be entitled to use your existing Ticket, including all registration fees, as credit for a future event hosted by World Visualization Foundation.

Force Majeure: World Visualization Foundation shall be relieved of its obligations if the Event or parts of it cannot be performed or the Event needs to be changed or terminated due to reasons or failure which result from anything beyond the reasonable control of World Visualization Foundation (e.g., extreme weather, flood, fire, terrorism, war, pandemic, governmental acts, risk to public health, etc.) or anything that would make a performance of the obligations illegal or impossible. In the event of force majeure, World Visualization Foundation shall be under no obligation to refund any tickets or fees. World Visualization Foundation shall be under no liability to the Participant which may result thereof.

If a Force Majeure event prevents or hinders the Event from taking place, World Visualization Foundation will endeavor to provide an alternative date or other forms of compensation, but any such decision will be at the sole discretion of World Visualization Foundation.

13. Final Provisions

The exclusive place of jurisdiction for all disputes arising from or in connection with these T&C shall be the competent court in Poland, depending on the World Visualization Foundation entity which is responsible for the respective Event.

These T&C are governed by the laws of Poland, depending on the World Visualization Foundation entity which is responsible for the respective Event, without giving effect to any principles of conflicts of law.

If any provision of these T&C is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

These T&C constitute the entire agreement between the parties concerning the subject matter hereof and supersede all prior agreements and understandings, both written and oral, between the parties in connection with such subject matter.

The Participant may not assign or transfer any of its rights or obligations under these T&C without the prior written consent of World Visualization Foundation. World Visualization Foundation may assign or transfer any of its rights or obligations under these T&C without the Participant’s consent.
